Hopen Technologies Inc. ("Hopen", "we", "us", or "our") is committed to protecting your privacy. This Privacy Policy explains how we collect, use, disclose, and safeguard your personal information when you use the Hopen mobile application and website (hopenapp.com) (collectively, the "Services").
This Policy applies to all users of Hopen worldwide. Jurisdiction-specific provisions that supplement or modify the general terms are set out in Section 15. Where local mandatory law grants you additional rights, those rights are preserved in full.

Automated Content Moderation
We use automated tools (including AI-based systems) to detect illegal content, copyright infringement, spam, and Community Guideline violations. If automated moderation results in a decision affecting your account (such as content removal or account restriction), you may request human review by contacting [legals@hopenapp.com].
To help you find friends who are already on Hopen, we offer an optional contact syncing feature. This feature is strictly opt-in and governed by your device's operating system permission architecture.

Right to Erasure — Technical Reality
When you delete your account or exercise your right to erasure, we initiate deletion from our primary production databases immediately. Data is purged from encrypted backup architectures during the natural overwrite cycle, which occurs within 90 days. We will confirm completion of deletion upon request. Certain categories of data (financial records, legal holds) may be retained as required by law even after an erasure request.
We take the privacy of minors extremely seriously and operate a multi-layered age verification and parental consent architecture.

How to Submit a Request
We will verify your identity before processing your request. We will respond within 30 days (GDPR) or 45 days (CCPA/CPRA). We may extend this period by an additional 30/45 days for complex requests and will notify you of any extension.
EEA / UK users: If we are unable to resolve your complaint, you have the right to lodge a complaint with your national data protection supervisory authority (e.g., the Irish DPC, CNIL, ICO for UK users, or your local authority). A list of EU supervisory authorities is available at: edpb.europa.eu.

Hopen is operated from Québec, Canada. When you use our Services, your personal information may be transferred to and processed in the United States or other countries where our servers and sub-processors are located, which may have data protection laws different from those in your country.

A. European Economic Area, United Kingdom & Switzerland (GDPR / UK GDPR)

Retention and Erasure
All retention periods set out in Section 10 apply. Your right to erasure is subject to overriding legal obligations. Automated deletion is triggered upon account closure.

E. Brazil (LGPD — Lei Geral de Protecao de Dados)
If you are located in Brazil, we process your personal data in accordance with the Lei Geral de Protecao de Dados (Law No. 13,709/2018). You have the following rights under the LGPD: confirmation of processing, access, correction, anonymization/deletion/blocking, portability, deletion of data processed with consent, information about sharing, information about consequences of withholding consent, and revocation of consent. F. Australia (Privacy Act 1988 / Australian Privacy Principles)

G. Republic of Korea (PIPA)
In the Republic of Korea, we comply with the Personal Information Protection Act (PIPA). The minimum age for use of the Services in Korea is 14. Users between 14 and 18 require parental consent. H. Japan (APPI)
In Japan, we comply with the Act on the Protection of Personal Information (APPI) and notify you of the purpose of use at the time of collection. Where required, we obtain your consent before collecting sensitive personal information. I. India (DPDPA 2023)
In India, we comply with the Digital Personal Data Protection Act, 2023. You have the right to access, correct, and erase your personal data, and to nominate a person to exercise your rights on your behalf. Contact us at privacy@hopenapp.com.
J. Germany
In Germany, the limitations on warranties and liability are subject to the mandatory provisions of German law (BGB Sections 305 et seq.). Liability for intent and gross negligence is not limited under German law.
K. France
In France, consumers retain the benefit of mandatory warranty protections under the French Consumer Code (garantie legale de conformite, garantie contre les vices caches). Nothing in this Policy limits rights afforded under the French Consumer Code.
We operate a Consent Management Platform (CMP) that allows you to review, grant, and withdraw granular consent for non-essential data processing activities at any time.
In compliance with Apple App Store Review Guideline 5.1.1(v) and Google Play policy, we provide a functional, easily discoverable account deletion mechanism directly within the application.

Temporary deactivation is available as an alternative to full deletion. Deactivation hides your profile and content but does not delete your data. You can reactivate your account at any time within [X] months of deactivation, after which your account will be permanently deleted.
We may update this Privacy Policy from time to time. For material changes, we will provide at least 30 days' advance notice via email to the address associated with your account and/or a prominent in-app notification, except where applicable law requires a different notice period.
We will update the "Last Updated" date at the top of this Policy. Your continued use of the Services after the effective date of the updated Policy constitutes acceptance of the changes.

These Terms apply to all users globally. Where your country of residence grants you additional or different rights under local law, those rights are preserved. Jurisdiction-specific provisions appear throughout this document and in Section 14.
Welcome to Hopen (the "Platform"), provided by Hopen Technologies Inc., a company incorporated in Québec, Canada (collectively referred to as "Hopen," "we," or "us").
These Terms of Service (the "Terms") govern the relationship between you and us and constitute a legally binding agreement setting forth the conditions by which you may access and use the Platform and our related websites, services, applications, products, and content (collectively, the "Services"). Our Services are provided for private, non-commercial use. For purposes of these Terms, "you" and "your" means you as the user of the Services.
Minimum Age
You must be at least 13 years of age to use the Services. In certain jurisdictions, a higher minimum age may apply:
Users who are above the applicable minimum age but under 18 (or the age of legal majority in their jurisdiction) may only use the Services with the verified consent of a parent or legal guardian who agrees to be bound by these Terms on the minor's behalf. By allowing a minor to use the Services, the parent or legal guardian accepts full responsibility for the minor's use.
We do not knowingly collect personal information from users below the applicable minimum age. If we become aware that such a user has provided us with personal information, we will promptly delete their account and all associated data. By accessing or using our Services, you confirm that you meet the minimum age requirement, that you are legally competent to form a binding contract (or have obtained verified parental consent), that you accept these Terms, and that you agree to comply with them. Your use of our Services is also subject to our Privacy Policy and Community Guidelines, incorporated herein by reference.
If you are accessing or using the Services on behalf of a business or entity: (a) "you" and "your" includes you and that entity; (b) you represent and warrant that you are an authorized representative with authority to bind the entity to these Terms; and (c) your entity is legally and financially responsible for all use of the Services under your account.
If you are a minor above the applicable minimum age, your parent or legal guardian must complete the parental consent process within the Platform before you may access certain features. We reserve the right to verify parental consent and to restrict or terminate accounts where verifiable consent cannot be confirmed.
You should save a copy of these Terms for your records.
We may amend these Terms from time to time — for instance, when we update functionality, combine apps or services, or when there are regulatory changes. For material changes, we will provide at least 30 days' advance notice via email to the address associated with your account and/or a prominent in-app notification, except where applicable law requires a different notice period. We will also update the "Last Updated" date at the top of these Terms.
Your continued use of the Services after the effective date of any updated Terms constitutes your acceptance of those Terms. If you do not agree to the updated Terms, you must stop using the Services and may delete your account before the effective date.
If you are an EEA or UK resident, we will not rely on your continued use alone as consent to changes that materially affect your rights. We will seek your explicit agreement where required by applicable law.
To access some features, you must create an account and provide accurate, up-to-date information. You must promptly update your details to keep them current and complete.

You are solely responsible for all activity that occurs under your account.

Account Deletion & Data Retention
If you wish to delete your account, contact us at contact@hopenapp.com. Upon deletion, we will delete or anonymize your personal data within 90 days, except where retention is required by applicable law or for legitimate purposes such as fraud prevention or resolution of legal claims. Any User Content that was shared with or re-posted by other users prior to deletion may remain accessible to those users as described in Section 7. For full details, see our Privacy Policy.
Your access to and use of the Services is subject to these Terms and all applicable laws and regulations. You may not:
We reserve the right, at any time and without prior notice, to remove or disable access to content for any reason, including content we determine to be objectionable, in violation of these Terms, or harmful to users or the Services.
Automated Processing
Our automated systems may analyze your content to provide features such as customized results, spam detection, and malware detection. This analysis occurs as content is sent, received, and stored. Where required by applicable law (including the GDPR), you have the right to object to certain automated processing of your personal data. Please see our Privacy Policy for further details.
We respect intellectual property rights globally and ask you to do the same. As a condition of your access to and use of the Services, you agree to the terms of our Copyright Policy. If you believe any content on the Services infringes your intellectual property rights, please contact us at contact@hopenapp.com with details of the alleged infringement.
Hopen Content
All content, software, images, text, graphics, illustrations, logos, trademarks, service marks, copyrights, photographs, audio, videos, music, and the "look and feel" of the Services, and all intellectual property rights related thereto (the "Hopen Content"), are either owned or licensed by Hopen. Use of Hopen Content for any purpose not expressly permitted by these Terms is strictly prohibited.
Subject to these Terms, you are granted a non-exclusive, limited, non-transferable, non-sublicensable, revocable, worldwide license to access and use the Services and Hopen Content solely for your personal, non-commercial use.
No rights are licensed with respect to sound recordings and the musical works embodied therein that are made available from or through the Service.
User-Generated Content
Users may upload, post, transmit, or otherwise make available content through the Services, including text, photographs, videos, sound recordings, and musical works embodied therein ("User Content"). Users may also overlay Hopen-provided music, graphics, stickers, and other elements ("Hopen Elements") onto User Content.
All User Content is considered non-confidential and non-proprietary. You warrant that you own, or have obtained all necessary permissions to post, your User Content, and that it complies with the standards set out in Section 5. You will be liable to us and indemnify us for any breach of that warranty.
License You Grant to Hopen
You or the owner of your User Content retain the underlying copyright. However, by submitting User Content through the Services, you grant us an unconditional, irrevocable, non-exclusive, royalty-free, fully transferable, perpetual, worldwide license to use, modify, adapt, reproduce, make derivative works of, publish, transmit, and distribute your User Content, and to authorize Hopen's service providers and partners to access and use your User Content solely as necessary to operate, improve, and promote the Services.
You further grant us a royalty-free license to use your username, image, voice, and likeness to identify you as the source of any of your User Content, subject to applicable age restrictions and local law.
EEA & UK users: To the extent this license constitutes processing of your personal data, it is based on our legitimate interests in operating the platform and/or your consent, as set out in our Privacy Policy. You may withdraw consent or object to processing at any time, subject to the terms of our Privacy Policy.
What Happens to Your Content After Account Deletion
Upon account deletion, we will cease actively displaying your User Content on the Services. We may retain copies as required by law, for safety or fraud-prevention purposes, or as residual backup copies for a limited period not to exceed 90 days. Any User Content that was shared with or re-posted by other users prior to deletion may remain accessible to those users within the Services to the extent technically necessary.
Music & Recording Artists
If you are a composer or author of a musical work and are affiliated with a performing rights organization (PRO), you must notify your PRO of the royalty-free license granted through these Terms. If you have assigned your rights to a music publisher, you must obtain that publisher's consent before granting the licenses herein. If you are a recording artist under contract with a record label, you are solely responsible for ensuring your use of the Services complies with your contractual obligations.
Feedback
Any ideas, suggestions, or feedback you send to us ("Feedback") will be treated as non-confidential. By submitting Feedback, you grant us an irrevocable, perpetual, royalty-free, worldwide license to use and exploit the Feedback for any purpose without restriction or attribution.
You agree to defend, indemnify, and hold harmless Hopen, its parents, subsidiaries, affiliates, and each of their respective officers, directors, employees, agents, and advisors from any and all claims, liabilities, costs, and expenses, including attorneys' fees, arising out of or related to: (a) your breach of these Terms; (b) your User Content; (c) your use of the Services; or (d) your violation of any law or the rights of a third party.
In some jurisdictions (including the EEA and UK), indemnity clauses may be subject to consumer protection limitations. Nothing in this section is intended to override rights you have under applicable mandatory consumer protection law.
Nothing in these Terms shall affect any statutory rights that you cannot contractually agree to alter or waive and are legally always entitled to as a consumer under your local law.
The Services are provided "as is" and we make no warranty or representation to you with respect to them. In particular we do not represent or warrant that: (i) your use of the Services will meet your requirements; (ii) use will be uninterrupted, timely, secure, or free from error; (iii) any information obtained through the Services will be accurate or reliable; or (iv) defects in the operation or functionality of any software will be corrected.
We may change, suspend, withdraw, or restrict the availability of all or any part of our Platform for business and operational reasons at any time without notice.
Nothing in these Terms shall exclude or limit our liability for losses which may not be lawfully excluded or limited by applicable law, including liability for death or personal injury caused by our negligence, or for fraud or fraudulent misrepresentation.
Subject to the above, we shall not be liable to you for: (i) any loss of profit; (ii) any loss of goodwill; (iii) any loss of opportunity; (iv) any loss of data; or (v) any indirect or consequential losses. Any other loss will be limited to the amount paid by you to Hopen within the last 12 months.
We only provide our Platform for domestic and private use. You agree not to use our Platform for any commercial or business purposes, and we have no liability to you for loss of profit, business interruption, or loss of business opportunity.
You are responsible for any mobile or data charges that may apply to your use of the Service.
EEA & UK users: Nothing in this section limits your rights under the EU Consumer Rights Directive, UK Consumer Rights Act 2015, or any other applicable mandatory consumer protection legislation. If you are a consumer, your statutory rights are not affected.
Our collection and use of your personal information is governed by our Privacy Policy, which is incorporated into these Terms by reference. Please review the Privacy Policy carefully.

We collect, use, and share personal information as described in our Privacy Policy. By using the Services, you acknowledge that we may transfer your data internationally, including to the United States, where data protection rules may differ from those in your country of residence.

Where we transfer personal data from the EEA, UK, or Switzerland to countries not recognized as providing adequate protection, we rely on Standard Contractual Clauses (SCCs) approved by the European Commission, the UK International Data Transfer Agreement (IDTA), or other lawful transfer mechanisms as described in our Privacy Policy.

If you are located in Canada, we comply with the Personal Information Protection and Electronic Documents Act (PIPEDA) and applicable provincial privacy laws, including Quebec's Law 25 (Law modernizing legislative provisions respecting the protection of personal information).
You have the right to access, correct, and withdraw consent to the processing of your personal information. Where required by Law 25, we will obtain your explicit consent before collecting sensitive personal information and will maintain a register of our personal information processing activities. E. Australian Users (Privacy Act 1988)
If you are located in Australia, we comply with the Australian Privacy Act 1988 (Cth) and the Australian Privacy Principles (APPs). You have the right to access and correct your personal information held by us. If you have a complaint about how we handle your personal information, please contact us at contact@hopenapp.com. If we are unable to resolve your complaint, you may contact the Office of the Australian Information Commissioner (OAIC) at www.oaic.gov.au.
F. Brazilian Users (LGPD)
If you are located in Brazil, we comply with the Lei Geral de Proteção de Dados (LGPD) (Law No. 13,709/2018). You have the rights of confirmation, access, correction, anonymization or deletion, portability, deletion of personal data processed with consent, information about sharing, information about the possibility of not providing consent and the consequences, and revocation of consent. Open Source
The Platform contains certain open source software. Each item of open source software is subject to its own applicable license terms, which can be found at our Open Source Policy.
Entire Agreement
These Terms constitute the whole legal agreement between you and Hopen and govern your use of the Services, completely replacing any prior agreements between you and Hopen in relation to the Services.
Links
You may link to our home page, provided you do so in a way that is fair, legal, and does not damage our reputation. You must not suggest any form of association, approval, or endorsement by us where none exists. We reserve the right to withdraw linking permission without notice.
No Waiver
Our failure to insist upon or enforce any provision of these Terms shall not be construed as a waiver of any provision or right.
Security
We do not guarantee that our Services will be secure or free from bugs or viruses. You are responsible for configuring your technology to access our Services securely and should use your own virus protection software.
Severability
If any court of competent jurisdiction rules that any provision of these Terms is invalid, that provision will be removed without affecting the remainder of the Terms, and the remaining provisions will continue to be valid and enforceable.
Exports
You agree not to export or re-export the Services to any country requiring a U.S. or applicable export license without first obtaining such approval, including to U.S. embargoed countries or parties listed on U.S. Government restricted-party lists.
A. Informal Resolution (All Users)
If we have a dispute with you relating to or arising out of these Terms, we will first try to resolve it amicably. You agree to do the same. The party raising a dispute will notify the other, and the receiving party will have 60 days to respond. If the dispute remains unresolved within 30 days of a response (or after the response period expires), either party may pursue further action. Completing this informal process is a prerequisite to filing any legal action. Both parties agree to make a good faith effort and agree that applicable limitation periods are tolled during this process.
B. US Users — Binding Arbitration & Class Action Waiver
Please read this section carefully — it affects your legal rights.
Except for disputes that qualify for small claims court, US users and Hopen agree that any dispute, claim, or controversy arising out of or relating to these Terms or the Services shall be resolved exclusively through binding individual arbitration — not in a class, collective, or representative action. You and Hopen each waive the right to a trial by jury and the right to participate in a class action lawsuit or class-wide arbitration.
Arbitration shall be conducted by JAMS under its applicable rules, with proceedings taking place in Los Angeles, California, or via video conference. The arbitrator's award shall be final and binding and may be entered as a judgment in any court of competent jurisdiction. Nothing in this Section prevents either party from seeking injunctive or other equitable relief in court for the protection of intellectual property rights or confidentiality obligations.
You have the right to opt out of this arbitration agreement within 30 days of first accepting these Terms by sending written notice to legals@hopenapp.com. Opting out does not affect any other provision of these Terms.
C. EEA & UK Users — Governing Law & Dispute Resolution
If you are resident in the European Economic Area, these Terms are governed by the laws of your EU Member State of residence. Nothing in these Terms affects your rights to bring proceedings before the courts of your place of residence or your rights under any mandatory consumer protection laws applicable in your jurisdiction.
If you are resident in the United Kingdom, these Terms are governed by English law. You may bring proceedings before the courts of England and Wales or the courts of Scotland or Northern Ireland (if you are resident there).
The European Commission provides an Online Dispute Resolution (ODR) platform available at: https://ec.europa.eu/consumers/odr. We are not required to participate in alternative dispute resolution but may do so at our discretion.
D. Governing Law — US Users & All Others
For US users, and for users in jurisdictions where local law does not mandate a different governing law, these Terms and any claims arising out of or relating to them shall be governed by the laws of the State of California, United States, without regard to its conflict of law provisions. Any disputes not subject to arbitration shall be resolved exclusively in the U.S. District Court for the Central District of California or the Superior Court of the State of California, County of Los Angeles.
E. One-Year Limitation Period (US Users)
US users and Hopen agree that any proceeding or action must be initiated within one (1) year of the date of the occurrence of the event or facts giving rise to the dispute. Otherwise, the right to pursue any such claim is permanently barred. This limitation does not apply where prohibited by applicable law.
The following additional provisions apply based on your country of residence and supplement (and, where specified, override) the general terms above.
A. Germany
In Germany, the warranty and liability limitations in Sections 9 and 10 are subject to the mandatory provisions of German law, including Sections 305 et seq. of the German Civil Code (BGB). Liability for intent and gross negligence is not limited. The right to terminate for good cause remains unaffected.
B. France
In France, consumers have the benefit of mandatory warranty provisions under French law (garantie légale de conformité, garantie contre les vices cachés). Nothing in these Terms is intended to limit rights afforded to consumers under the French Consumer Code (Code de la consommation).
C. Republic of Korea
In the Republic of Korea, users under 14 may not use the Services. We comply with the Act on Promotion of Information and Communications Network Utilization and Information Protection and the Personal Information Protection Act (PIPA). You have the right to access, correct, delete, and suspend processing of your personal information. To exercise these rights, contact us at contact@hopenapp.com.
D. Japan
In Japan, we comply with the Act on the Protection of Personal Information (APPI). Where required, we will obtain your consent before collecting sensitive personal information and will notify you of the purpose of use. E. India
In India, we comply with the Information Technology Act, 2000 and applicable rules, including the Digital Personal Data Protection Act, 2023 (DPDPA). By downloading the Platform from Apple's App Store, you acknowledge and agree that:
Google Play
By downloading the Platform from Google Play, you acknowledge that: (a) to the extent of any conflict between the Google Play Terms and these Terms, the Google Play Terms shall apply with respect to your use of the Platform; and (b) Google has no responsibility or liability for compliance or non-compliance by Hopen or you under these Terms or the Google Play Terms.
